HEALTH GUARANTEE OBLIGATIONS:

This contract is written for the protection of the breeder, the buyer, and the puppy. To the best of the breeder's knowledge, the puppy is in good health at the time of sale.

Your puppy is guaranteed for one (1) year from date of purchase by the seller against any non-treatable, life-threatening congenital defect. The exceptions are skin or ear problems that may develop after the sale of the puppy. We do not guarantee against parasites (internal/external), parvo virus, cherry eye (which is considered to be a breed defect), any type of hernia, submissive wetting, and/or behavioral problems (as training philosophies and environment vary amongst individuals). It is the responsibility of the buyer to train and socialize the puppy. A diagnosis of coccidia, giardia, kennel cough or any other type of bacterial infection does not render your puppy unhealthy, as these items can be found on the ground, in water, and public places and are treatable conditions.

If the puppy is examined by a licensed veterinarian and found to have a non-treatable, life-threatening congenital defect condition, the seller shall refund part of the purchase price of the puppy only, or replace the puppy, provided that the AKC registration papers are returned, for the next available puppy of the same sex, color, and like pedigree. All return shipping charges are the responsibility of the purchaser.

A copy of the vet report must be given to the seller at the time of notification. In the event of death, an autopsy report shall be performed at buyer's expense to determine the congenital defect and cause of death. The report must be provided before a replacement pup is given. The breeder is not responsible for any vet charges or fees in diagnosing or treating any illness or genetic defect. There will be no replacement pup given if the death was the result of abuse, neglect, or accident.

This puppy is warranted only for the purpose of companion animal. There is no warranty given as to its fitness or size for any special purpose.

This contract only pertains to the buyer to whom the puppy was sold and registered to on the date of purchase. If this puppy is transferred to another person, this contract is void.

BUYER'S OBLIGATIONS:

The puppy shall be maintained in good health and be examined by a licensed veterinarian at the buyer's expense within 72 hours of receiving the puppy from the seller. This requirement will be extended if the 72 hours should fall on a holiday or Sunday. A stool sample should be included at the first visit.

The buyer agrees that if he/she is unable to keep this Cocker Spaniel he/she will not give away or otherwise dispose of this puppy/dog without first contacting the breeder, who will either accept the dog on a return basis or assist the buyer in finding a suitable alternative home for the dog. This does not imply a financial commitment on the part of the breeder. We do not want any of our puppies going to an unsuitable home or surrendered to a shelter or rescue. All AKC papers and health records must be returned with the dog.

This Cocker Spaniel shall not be used in any puppy mill operation, nor produce puppies for resale in pet shops, labs, or any organization whose intent is to resell, trade, or give away puppies to be used in any lab experiments.

The buyer agrees to provide the puppy with proper exercise, diet, shelter, and general care and provide veterinary care including checkups, heartworm preventative, vaccinations, and worming.

The buyer agrees that the breeder is not liable for any vet bill, loss, death, or injury at any given time.

Please do not take the puppy into public places unless absolutely necessary, until the puppy has had all its vaccinations (as recommended by your veterinarian) to insure immunity against disease.

A down payment of $150.00 to hold a puppy is non-refundable. If puppy is not purchased, NO CASH REFUNDS. I accept payments in the form of cash, postal money orders, or Wal-Mart money grams.

All vet and shipping charges incurred by purchaser are the sole responsibility of the purchaser and will under no circumstances be paid by the breeder. If shipping is required, the breeder is not responsible if the puppy is injured, lost, stolen, killed or occurs health problems. The breeder does not assume any liablility for injury of said puppy after the date of shipping. The price of the puppy and shipping costs will need to be paid in full by the time the puppy is 7 weeks old so all shipping arrangements can be made. Breeder will not hold a puppy if shipping is not paid by the time the puppy is 7 weeks old, and all monies put down on said puppy will be forfeited to the breeder. I require pre-payment, because I do not want any puppies left at an airport unattended.

By signing this guarantee the buyer waives all rights to file any legal claim against the breeder. I have read and agree to the above terms.
